This Privacy Notice (“Privacy Notice”) sets forth the ways in which we, Casio Computer Co., Ltd., (hereinafter “we”, “our” or “us”) collect, use and disclose your information when you register for and use our services provided through the website of “Casio Teacher Members”, which is our website for mathematical education (“Services”).

Please read the following carefully to understand how we will treat your information provided via your registration for and use of the Services.

1. Member Information

When you register for the Services, we collect your information, such as your name, birth date, gender, email address, country, school name, school type (public or private) and subject in charge.

When you use the Services, we collect any information that you actively submit to us, including any information that you provide on any forms that you submit to us or through any other communications or interactions you have with us. We also automatically collect information during your use of the Services, specifically: your IP-address, host name, user agent, browser identification, referrer, and the date/time of your access to the website of the Services while using your account registered for the Services.

We refer to the information about you described above as “Member Information”

2. Legal basis for and purpose of usage

We will process Member Information based on any of the following legal basis (unless such data processing will conflict with applicable laws and regulations) or any other grounds as permitted under applicable laws;

  • (i)Contract. When we need to process Member Information to perform a contract we enter into with you;
  • (ii)Legal Obligation. When we need to comply with a legal obligation;
  • (iii)Legitimate Interests. When the processing of Member Information is necessary for the fulfilment of legitimate interests pursued by us or a third party and your interests and fundamental rights do not override those interests; and
  • (iv)Consent. When you have given consent for us to process Member Information. However, even if we did not obtain consent from you, we may process Member Information based on other applicable legal grounds. The withdrawal of your consent shall not affect the lawfulness of processing performed based on the consent before your withdrawal.

We use Member Information for the following purposes (“Purposes”):

  • (i)to complete your registration for the Services, to verify your identity when providing you with the Services, to provide you with the Services, and to manage and administer your account for the Services;
  • (ii)to personalize and optimize the Services for you and to enhance the user experience of the Services;
  • (iii)to conduct market research and/or analysis for statistical or other purposes for us to review, develop and improve the quality of and to promote sales of our products and services (including the Services);
  • (iv)to (a) send questionnaires to you for design and improve our products or services (including Services) customized to interests of consumers, and (b) as permitted by applicable law, send you information by Casio, our affiliates or our local distributors about our products and services (including the Services which you have not yet used) and benefits (including without limitation special events, promotions and campaigns held by Casio, our affiliates or our local distributors) which might be of interest to you; and
  • (v)to contact you concerning your queries, or for any security and fraud prevention purposes.

During the period you register and maintain your account for the Services, Member Information may be processed and used in the form(s) of printed documents and/or electronic files or otherwise by us and the parties prescribed in Clauses 5 and 6.

3. Management of Member Information

We have taken steps to protect Member Information in an appropriate manner, including to protect personally identifiable information included in Member Information. We collect, use and disclose (including cross-border transfer) Member Information to the extent permitted or required under applicable laws and guidelines. In addition to this Privacy Notice, we follow our “Privacy Policy”

4. Storage Location

The Member Information is transmitted to and stored in a server operated by our service providers, which server may be located outside of your country.

5. Data sharing

In accordance with applicable data protection laws, including Japanese law in connection with the framework of joint use, we share Member Information with the distributor for our educational products in your country. The categories of Member Information that is shared are your name, email address, school name, school type and subject in charge. The purposes of sharing are the same as the Purposes stated in (iii), (iv) and (v) of Clause 2 hereof. Each entity is responsible for the management of Member Information which it collects from you.

6. Disclosing Member Information to third parties

Member Information may be disclosed to our subsidiaries, distributors, service partners, service providers and subcontractors as necessary to accomplish the Purposes. Additionally, we may disclose Member Information to any judicial or governmental authorities, courts, external advisors, and similar third parties, if so requested by them, in accordance with any applicable laws, rules or regulations.

7. Cross-border transfers

Member Information may be transferred to, and stored by, a third party outside the country where you live, or which you were in when you accessed our website or used the Services. Such countries include the countries in which our affiliates, subsidiaries, distributors, service providers and subcontractors above are located.

8. Non-mandatory

You are NOT obligated in any way to provide your information to us. However, if Member Information necessary for the Services is not provided to us, you may not receive the Services in whole or in part.

9. Retention period

Member Information will be retained only for as long as necessary for accomplishment of the Purposes, or as allowed by law.

10. Your rights

You have a number of legal rights in relation to Member Information. These rights may vary depending on where you are located and which data protection laws will apply to the relationship between you and us, but would typically include;

  • (i)the right to obtain information regarding the processing of Member Information and to access to Member Information;
  • (ii)the right to request that we rectify Member Information if it is inaccurate or incomplete;
  • (iii)the right to request that we erase Member Information;
  • (iv)the right to request that we restrict our processing of Member Information;
  • (v)the right to object to us about our processing of Member Information;
  • (vi)the right to receive a copy of any of Member Information where this is technically feasible; and
  • (vii)the right to withdraw your consent to our processing of Member Information.

You can exercise your rights by contacting us through the information about us described in Clause 12. You can also lodge a complaint with the data protection regulator if you think that any of your rights have been infringed by us.

11. Changes to this Privacy Notice

We reserve the right to make changes to this Privacy Notice by posting such changes on our website. Changes are effective immediately upon posting unless a different effective date is stated, however, if specifically required to do so by applicable laws, we will seek your prior consent before adopting such changes in respect of Member Information.
